Arbitration Breakfast Briefing: apparent bias and arbitrators’ duty of disclosure in international commercial arbitrations following the Supreme Court’s decision in Halliburton v Chubb; and the duty of expert witnesses in arbitration proceedings to avoid conflicts of interest.

Join Stuart Isaacs QCJamie Holmes and Jia Wei Lee in a discussion about the scope of the obligation of arbitrators involved in international commercial arbitrations to make disclosure of possible conflicts of interest, the circumstances in which this might lead to a finding of apparent bias that requires their removal, and the interaction with their other contractual duties, in the light of the Supreme Court’s decision in Halliburton Company v Chubb [2020] UKSC 48.

The discussion explores what the case decides, whether, after the initial flurry of interest in this long-awaited decision, its significance has been overestimated and what its implications will be going forwards.

This arbitration breakfast briefing also gives the opportunity to consider the Court of Appeal’s 11 January 2021 decision in Secretariat Consulting Pte Ltd v A Company [2021] EWCA Civ 6 which concerned the duty of a party-appointed expert in arbitration proceedings to avoid conflicts of interest and the interaction of this with their other contractual duties.
