Setting aside judgments on the grounds of fraud
On 20 March 2019, the Supreme Court (sitting with 7 justices) gave judgment in Takhar v Gracefield Developments Ltd unanimously allowing the appeal and clarifying the test for setting aside judgments on the grounds of fraud. John Wardell QC and Andrew Mold acted for the successful appellant.
In this seminar, John and Andrew and Jia Wei Lee will:
(1) explain the background to the case;
(2) consider the competing policy objectives and the reasoning given in the 4 judgments by Lord Kerr, Lord Sumption, Lord Briggs and Lady Arden;
(3) consider some of the practical implications of the decision.
