This webinar was delivered by Tom Robinson, Simon Atkinson and Francesca Mitchell. James Walmsley chaired the session.

Issues for the trustees:

  1. scope of trust powers and statutory obligations;
  2. revising schedules of contributions and getting actuarial input;
  3. keeping the membership on board; and
  4. regulatory and taxation issues.

Issues for the employer:

  1. Insolvency Act provisions, and changes due to Covid-19;
  2. TPR guidance;
  3. the stance of the Courts to date; and
  4. particularities of the scheme as creditor; can you justify treating the Scheme unlike other creditors?
