Last week, judgment was handed down by the Court of Appeal in the high-profile cryptocurrency case of Tulip Trading v Van Der Laan; the Court reversed the decision of Falk J and dismissed the jurisdiction applications brought by various of the defendants against the claimant, Tulip Trading.
This decision – which allows Tulip Trading’s case to proceed to trial – is of significant interest as the trial will address the question of whether or not digital currency networks are in fact decentralised, as well as determining the existence of the fiduciary and tortious duties in question.
John Wardell KC, Bobby Friedman and Sri Carmichael, who acted for the successful appellant, discussed the background to the case, the reasoning of the Court and considered the ‘takeaway points’ for practitioners. The webinar was chaired by Tim Penny KC.
